1. Acceptance of Terms
By registering, accessing and using the website wissenly.com (the “Service”) and purchasing any digital products, templates, e-books, courses, or other digital content (collectively, “Products”) offered by [Wissenly Digital Sources] (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“ToS”) and our Privacy Policy (embed link from a page you made for Privacy Policy in “Privacy Policy” sentence. 2. Digital Products and Delivery
2.1 Product Description
We sell various digital products, including but not limited to digital courses, videos, e-books, notes and planners. We make every effort to display and describe the Products accurately.
2.2 Delivery
Upon successful payment, digital products are delivered immediately or within 24 hours – 3 working days (not including Saturdays, Sundays and Malaysian public holidays) subject to payment approval via wissenly.com website access information on the thank-you page and/or sent to the email address provided by yourself during checkout. You are responsible for ensuring you have the necessary software and technical ability to download and use the products.
3. Payments and Pricing
3.1 Pricing
All prices listed on wissenly.com are in RM or USD currencies and are subject to change without prior notice.
3.2 Payment Processing
Payment is processed through third-party payment gateways; either Stripe, PayPal, and Billplz. We are not responsible for any issues arising during the payment process on the third-party platforms.
4. Refund and Cancellation Policy
4.1 General Policy for Digital Products (No Refund)
Due to the nature of digital goods, which are instantly accessible and cannot be returned, all sales are final and non-refundable.
- We only offer a refund if:
- The digital file is proven to be corrupted, inaccessible or unusable, and we are unable to resolve the technical issue within 7 working days.
- There was a verified double charge error on our part.
Refund requests must be submitted to hello@wissenly.com within 3 working days of the purchase.
4.2 Exceptions (When a Refund May Be Considered)
- While sales are generally final, we will consider granting a full refund only under the following limited circumstances:
- Technical Failure/Corrupted File: If the digital file provided is proven to be corrupted, defective, or permanently un-downloadable and we are unable to fix the technical issue or provide a working replacement file within seven (7) working days from the time you reported the issue.
- Verified Double Charge: If our payment system incorrectly processed your order resulting in a verifiable duplicate charge for the same Product.
4.3. Submission of Refund Request
All requests for a refund under the specific exceptions listed in Section 2 must be submitted formally.
- Timeline: Requests must be made within seven (7) days of the original purchase date.
- Method: Requests must be emailed to hello@wissenly.com with the following information:
- Subject Line: REFUND REQUEST - [Your Order Number]
- Full Name and Email used for purchase.
- Date of Purchase.
- A detailed explanation and evidence (e.g., screenshots or error messages) proving that the file is defective or corrupted, or proof of the double charge.
4.4. Review Process
We reserve the right to verify the validity of the technical issue reported. If the issue is determined to be the result of the customer’s hardware, lack of appropriate software, or inability to follow instructions, the refund request will be denied.
4.5. Termination of License upon Refund
If a refund is approved and processed, your license to use the Product (as detailed in Section 5 of the ToS) is immediately and permanently terminated. You must immediately delete all copies of the Product files, including backups, from all devices and storage locations. Continued use of the Product after a refund is considered a violation of our intellectual property rights.
5. Intellectual Property and Licensing
5.1 Ownership
All Products and content on the Service, including the Wissenly brand, logo, website design, and underlying code, are and shall remain the exclusive property of Wissenly Digital Resources and are protected by copyright, trademark, and other intellectual property laws.
5.2 Product License
When you purchase a Product, you are granted a non-exclusive, non-transferable license to use the Product for personal or internal commercial use only.
- YOU MAY NOT:
- Resell, redistribute, sublicense, or share the Product, in whole or in part, in its original or modified form.
- Claim ownership of the Product, even if modified.
- Use the Product in any way that violates these ToS or any applicable laws.
6. User Responsibilities
You agree not to use the Service or the Products for any unlawful purpose or in any way that violates these ToS. You are responsible for maintaining the confidentiality of any login credentials associated with your account.
7. Disclaimer of Warranties and Limitation of Liability
7.1 "As Is" Basis
The Service and all Products are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
7.2 Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall we be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service or Products; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.
8. Governing Law and Jurisdiction
These ToS shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Selangor, Malaysia to resolve any legal matter arising from these ToS.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these ToS at any time. We will provide at least 30 days notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
9.1 Right to Terminate or Suspend
We reserve the right to immediately suspend or terminate your access to the Service, including any user account login access, and cease providing you with Products and services, without prior notice or liability, if you are found to be in breach of any term of these ToS, including but not limited to, violations of the Intellectual Property and Licensing terms (Section 5).
9.2 Consequences of Termination
- Upon termination of your account for breach of these terms:
- Your right to use the Service will immediately cease.
- You must immediately cease all use of any Products obtained through the Service in violation of the licensing terms.
- No refund will be provided for any Products purchased prior to termination.
- We reserve the right to pursue any legal remedies available under the laws of Malaysia.
